How is overtime pay calculated in Canada?
Overtime is set by each province, not nationally. Most provinces pay 1.5x (time and a half) once you pass a weekly threshold — 44 hours in Ontario, Alberta and New Brunswick, 48 in Nova Scotia and PEI, and 40 in Quebec, Newfoundland, the federal jurisdiction and others. Some provinces also have a daily threshold of 8 hours per day.
When does double time apply in British Columbia?
British Columbia is the main jurisdiction with double time: you earn 1.5x after 8 hours in a day, then 2x after 12 hours in a single day. On a 13-hour shift at $30/hr you get 8 hours at $30, 4 hours at $45, and 1 hour at $60 — $480 for the day.
How does Alberta calculate overtime — daily or weekly?
Alberta pays the greater of the daily calculation (over 8 hours per day) or the weekly calculation (over 44 hours per week) at 1.5x. You are never paid overtime twice for the same hours; the employer uses whichever method gives you more overtime.
Why is overtime based on minimum wage in some provinces?
New Brunswick, Nova Scotia and Newfoundland & Labrador set the statutory overtime rate at 1.5x the minimum wage, not 1.5x your own wage. If you already earn well above minimum wage, the legal overtime rate can be lower than your regular wage — in which case you are simply paid your regular wage. Employers and union contracts can be more generous.
Who is exempt from overtime pay in Canada?
Common exemptions include managers and supervisors, certain professionals (doctors, lawyers, engineers, accountants), some IT and commission salespeople, and farm workers in several provinces. Being salaried does not by itself make you exempt — check your provincial employment-standards office.
Does the federal jurisdiction have different overtime rules?
Yes. Federally regulated workers (banks, airlines, telecom, interprovincial transport) follow the Canada Labour Code: 1.5x after 8 hours in a day or 40 hours in a week.
