How much severance am I entitled to in Ontario?

Two separate ESA entitlements: termination notice (or pay in lieu) of 1 week after 3 months, rising to 8 weeks at 8+ years; plus severance pay of 1 week per year of service (including partial months), capped at 26 weeks — but only if you have 5+ years of service and the employer has a $2.5 million+ global payroll or severed 50+ employees within 6 months. Common-law entitlements are usually higher.

Is statutory notice all I am owed when terminated without cause?

Usually not. Unless a valid employment contract limits you to the statutory minimum, courts award common-law “reasonable notice” based on the Bardal factors — age, length of service, character of the position and availability of similar work. Awards commonly run several months and can reach 24+ months, far above the 1–8 statutory weeks.

Is the “one month per year of service” rule real?

No — it is a myth. Courts have repeatedly rejected mechanical formulas for reasonable notice. Short-service employees in specialized or senior roles can receive proportionally more, and there is no automatic one-month-per-year entitlement or cap. Every case depends on its facts.

How does federal (Canada Labour Code) severance work?

Federally regulated employees (banks, airlines, telecom, interprovincial transport) get graduated notice — 2 weeks after 3 months, 3 weeks at 3 years, then 1 extra week per year up to 8 weeks (in effect since February 1, 2024) — plus separate severance pay after 12 months: the greater of 2 days’ wages per completed year and 5 days’ wages.

Do BC, Alberta and Quebec have severance pay?

They require termination notice or pay in lieu (up to 8 weeks), but no separate statutory severance pay like Ontario’s ESA or the Canada Labour Code. BC calls its entitlement “compensation for length of service.” Quebec adds a powerful remedy: after 2 years of service you can challenge a dismissal made without good and sufficient cause.

Is severance pay taxable?

Yes. Pay in lieu of notice is taxed like salary with CPP and EI deducted. Severance paid as a retiring allowance has no CPP/EI but takes flat tax withholding, and a portion can sometimes be transferred to an RRSP — with extra room for years of service before 1996 — to defer the tax.
